The applicant must provide and attach a narrative of this application including information on grounds for appeal and reasons, with respect to both law and fact, for granting the appeal, special exception, or variance. If a hardship is claimed, state the specific hardship. If applying for a Variance, this required narrative must address the following section.
  6. This section is to be completed if you have checked item "B" in the "Type of Appeal" box. Per §910.2 of the Pennsylvania Municipalities Planning Code (MPC) and §440-903.A.1 of the Peters Township Code of Ordinance, no variance shall be granted until the applicant has established, and the Zoning Hearing Board, has made all of the following findings (A through E) where relevant in a given case. Please indicate which of the following you feel is applicable to your Variance request.
  7. A. Unnecessary hardship due to unique physical circumstance.
    That there are unique physical circumstances or conditions, including irregularity, narrowness, or shallowness of lot size or shape or exceptional topographical or other physical conditions peculiar to the particular lot, and that the unnecessary hardship is due to such conditions and not the circumstances or conditions generally created by the provisions of the Zoning Ordinance in the neighborhood or district in which the lot is
  8. B. Unique physical circumstances hinder property development.
    That because of such physical circumstances or conditions, there is no possibility that the lot can be developed in strict conformity with the provisions of the Zoning Ordinance and that the authorization of a variance is therefore necessary to enable the reasonable use of t
  9. C. Unnecessary hardship not created by appellant.
    That such unnecessary hardship has not been created by the appellant. Financial hardship shall not be construed as the basis for granting a variance.
  10. D. Character of the neighborhood will not change.
    That the variance, if authorized, will not alter the essential character of the neighborhood or district in which the lot is located, nor substantially or permanently impair the appropriate use or development of adjacent lots, nor be detrimental to the public welfare.
  11. E. Appeal represents the least modification possible.
    That the variance, if authorized, will represent the minimum variance that will afford relief and will represent the least modification possible of the regulation in issue.
  12. In granting any variance, the Township Zoning Hearing Board may attach such reasonable conditions and safeguards as it may deem necessary to implement the purposes of the laws of the Commonwealth of Pennsylvania and Chapter 440 of the Peters Township Code of Ordinances.
